LAHORE: The Federal Tax Ombudsman (FTO) has remanded back a tax refund appeal filed by the Proprietor Allah Din Contractor against the Regional Tax Office (RTO) Sargodha.
FTO Advisor Mian Munawar Ghafoor heard the case in which counsel for appellant argued that RTO has failed to release the refund since three years.
He said that the RTO has been collecting excessive taxes from the Proprietor Allah Din Contractor for the past three years. He approached the officer concerned many a time for release of refunds, but the RTO Sargodha officials did not pay heed to the request after the fall of a reasonable time.
Finally, the appellant decided to approach the Federal Tax Ombudsman (FTO), seeking his intervention in the case. The counsel appealed the FTO advisor to direct the RTO Sargodha to clear the refund claims as early as possible.
The counsel further said that delay in release of refund claims puts burden on the taxpayers therefore RTO should make audit of the cases and release the extra amount collected from the taxpayers.
On the other hand, counsel for RTO Sargodha argued that the appellant has not submitted all record in the office on the basis of which it is claiming refunds. If appellant provides accurate record, the RTO will release refunds, if any, after a proper assessment, he assured.
After hearing arguments from both sides, Advisor Mian Munawar Ghafoor has remanded back the appeal and directed the parties to appear on the said date to present arguments in the case before the relevant forum.
