KARACHI: The Collectorate of Customs Adjudication-II has issued a show-cause notice to M/s T. M. Group of Companies for evasion of duty and taxes to the tune of Rs2.3 million on import of different kind of chemicals.
According to sources, M/s T. M. Group of Companies imported consignments of different chemicals under PCT Heading 3106.9010 and cleared the same with active connivance of their clearing agent M/s Faree Shipping through Customs Appraisement (East), paying customs duty 0%. The subject goods, however, are correctly classified under PCT heading 3826.9019 where custom duty (CD) is livable at the rate of 10%. The mis-declaration of classification is also confirmed by the public.
Thus M/s T.M. Group of Companies by way of mis-declaration of PCT deprived the national exchequer of its legitimate revenue of duty and taxes to the tune of Rs2.3 million.
Therefore, the uimporter, has violated the provisions of Section 32 (1) (2) & (3A) of the Customs Act, 1969, Section 3, 6 & 7 read with Section 36.
Accordingly, 2 separate audit observations were issued to the said importer. The importer, however, failed to come up with any tangible evidence and explanation and was also unable to refute the charges leveled by the department. In view of the aforesaid M/s T. M. Group of Companies are held to have intentionally & willfully caused loss to the Government exchequer Rs2.3 million.
The Collectorate of Customs Adjudication-II after thoroughly studying the contravention reports have issued show-cause notice to appear in person.
