KARACHI: The Sindh High Court (SHC) has directed the tax authorities to release the consignment of “commercial / miscellaneous goods “on subject to payment of entire differential amount by the petitioner in the shape of pay-order on a constitution petition filed by M/s Syscom International seeking release order of its consignment.
A two-member bench, comprising Justice Munib Akhter and Justice Anwar Hussain was hearing the constitution petition.
During the hearing counsel for respondents submitted that the petitioner shall either deposit a pay order in the sum of Rs2 million with the nazir of this court or shall give bank guarantee that is acceptable to the nazir for the like amount.
After the arguments, court directed the respondents that after the same amounts goods lying at the aforesaid respondents shall be allowed to be released immediately.
Earlier, petitioner’s counsel stated that petitioner has imported 802 cartons of commercial / miscellaneous goods from China at a declared invoice value of $707.070.20 dated December 21, 2014. However, during the examination, respondents claimed, whereas iron steel badminton racket is assessable on the basis of 90 days evidential data $0.50 to 1/ piece.
According to the petitioner, respondents issued show cause notice to the petitioner and amount of Rs. 2,196,339 has been raised against the petitioner.
Citing Chairman Federal Board of Revenue ( FBR ), Ministry Port and Shipping, Collector of Customs Model Customs Collectorate, Appraisment-West as respondents, Petitioner pleaded the SHC may declare that act of the respondents malafide, unjustified, unlawfully and illegall and direct the respondents to issue delay detention certificate.
