KARACHI: The Sindh High Court (SHC) issued notices to the customs department and deputy attorney general on a petition filed by M/s Spark World Private Limited challenging Valuation Ruling No 1089/2017 which is not applicable to LED TV parts imported by the petitioner.
On 2 October 2019, a two-member bench headed by Justice Aqeel Ahmed Abbasi directed them to file their para wise comments on next date of hearing. Counsel for the petitioner argued that during the course of business, petitioner imported a consignment of LED TV parts from Grace World UAE, Dubai dated 26/06/2019 and filed goods declaration through its authorized clearing agents for clearance of the same through customs computerized system of Appraisement East, Karachi.
He further submitted that to the utter of the petitioner, the customs department during examination process by the concerned section of the clearance collectorate intercepted the clearance process and blocked/detained petitioner’s under-reference consignment at gate-out stage through verbal orders without assigning any reason for such arbitrary detention.
He argued that the consignment has not so far been examined and assigned to gate-out while the respondent has no jurisdiction for examination, detention or seizing goods lying in the customs area under clearance collectorate’s control.
Citing secretary Revenue Division, director Intelligence & Investigation (Customs), assistant director I&I-FBR and Collector of Customs Appraisement East as respondents, petitioner pleaded the court to declare the act of the respondents as illegal, malafide and arbitrary.
He further pleaded the court may declare that Valuation Ruling No 1089/2017 meant for complete LED TV sets of various brands of sizes 32 inches to 85 inches in not applicable to LED TV parts imported by the petitioner.
