KARACHI: The Sindh High Court (SHC) has directed the customs authorities to ensure filing of their comments on a constitutional petition filed by M/s Al Shaikh Associates, challenging Valuation Ruling No 1268/2018 dated 7/3/2018 enhancing 100 percent valuation on import of roller Chain imported by it. A two-member bench, headed by Justice Munib Akhtar, was hearing the matter.
Earlier, counsel for the petitioner stated that the petitioner is importer of roller chain in the brand of M/s Al-Shaikh Associates and always fulfills his liabilities according to law and never involved in any crime.
The counsel argued that the petitioner is seriously aggrieved by the action of the Collector of Customs Collectorate Appraisement East which assessed the imported consignments of the roller chain under Valuation Ruling No 1268/2018 dated 7/3/2018 and enhanced 100 percent at the same without fulfilling legal requirements.
Citing Chairmen Federal Board of Revenue, Chief Collector of Customs Model Customs Collectorate Appraisement South, Collector of Customs Collectorate Appraisement East, Director General Valuation as respondents, petitioner pleaded the court to declare the act of the respondents as illegal, mala fide and arbitrary.
He also pleaded the court may set aside impugned notification and restrain them from taking any coercive action against the petitioner till final order in this petition.
