KARACHI: The Sindh High Court (SHC) directed customs officials to file their comprehensive para wise comments on a petition filed by M/S Orange Motorcycle Company Private Limited seeking release order of its consignment of motorcycle/three wheeler auto-loaders seized by customs officials due to disputed valuation.
On September 04, 2018, a two-member bench, headed by Justice Aqeel Ahmed Abbasi, was hearing the petition. During the hearing, counsel for the petitioner stated that petitioner import motorcycle/three wheeler auto-loader according with law in un-assembled condition which are then assembled in its workshop for commercial sale as built unit ready-to-use and always fulfills all the legal formalities.
Counsel argued the petitioner purchased 90 units of three-wheeler auto loader for WUXI Berang International and filed goods declaration according with law; however, he was informed by the customs officials that its consignment was seized by the authorities due to alleged disputed valuation.
Citing secretary Revenue Division, chairman Federal Board of Revenue, collector of Customs Collectorate East, Deputy Collector of Customs Collectorate Appraisement East, assistant collector of Customs Collectorate Appraisement East as respondents, counsel pleaded that court to declare the act of the respondents as illegal, mala fide and arbitrary.
He also pleaded the court to direct them to release the consignment of petitioner and restrain them from taking any coercive action against the petitioner till final order in this petition. After the hearing, court directed customs officials to make sure submitting of their comments on next date of hearing.
