KARACHI: The Sindh High Court (SHC) has directed customs officials to file their comments on a constitutional petition filed by M/s Goldway Hygiene Products, challenging enhancement of valuation of a consignment of non-woven raw material for diaper imported from China. A two-member bench, comprising Justice Munib Akhtar and Justice Omer Sial, heard the petition.
Earlier, counsel for the petitioner stated that it is engaged in the lawful business of import of raw material for diaper from China and imported 23830.10 kilogram raw material, unit price @ $2.10, and filed Goods Declaration according to the law.
He submitted that after filing Goods Declaration it has paid Rs 2,108,977 as duty and taxes accordingly, however, the petitioner is seriously aggrieved by act of the respondents who enhanced the value from $2.10 to to $4.10 illegally and without lawful authority.
Citing Chairman Federal Board of Revenue, Collector of Customs Collectorate of Appraisement, Director General Directorate General of Customs Valuation and other as respondents, petitioner pleaded the court to declare the act of the respondents as illegal, mala fide and arbitrary, he also pleaded the court may restrain them from charging extra amount over duty and taxes on its consignment.
