KARACHI: The Sindh High Court (SHC) has issued notices to the customs authorities and deputy attorney general to file their respective para wise comments on a constitutional petition filed by M/s Crown Winding Wire Industries, challenging imposition of regularity duty on varnish, including polyester/ polyamide (wire general varnish) under Valuation Ruling no 1035(1)/2017 dated Oct, 16, 2017. A two-member bench, headed by Justice Munib Akhtar, was hearing the petition.
Earlier, counsel for the petitioner stated that he is importer and fulfills all the liabilities according to the law. However, being aggrieved and dissatisfied with the unlawful imposition of regularity duty on import of goods vide SRO 1035(1)/2017 dated Oct, 16, 2017 on different types of varnish, including polyester/ polyamide (wire general varnish) HS Code is 3208.9020, imported by the petitioner. The counsel argued that the petitioner has no other remedy but to prefer the titled constitutional petition, challenging inter alia, imposition of regularity duty.
Citing Chairman Federal Board of Revenue, Secretary Revenue Division, Collector of Customs Collectorate Appraisement West, Collector of Customs Collectorate Appraisement East and Collector of Customs Collectorate Appraisement Port Muhammad Bin Qasim as respondents, importer pleaded the court to declare the act of the respondents as illegal, mala fide and arbitrary.
He also pleaded the court may sed aisde impugned valuation ruling and restrain them from taking any coercive action against the petitioner till final order in this petition.
