KARACHI: The Sindh High Court directed customs authorities to file comments on a constitutional petition filed by M/s Inovi Technologies against imposition of regularity duty on import of refrigerators and air conditioners, washing machine and other similar goods under Valuation Ruling Number 1035(1)/2017 dated October,16, 2017. A two-member bench, headed by Justice Munib Akhtar was hearing the petition.
Counsel for the petitioner stated in its constitutional petition that it is engaged in the lawful import of above mentioned goods and always fulfills all the liabilities according with law, however, being aggrieved and dissatisfied with the unlawful imposition of regularity duty on import of goods vide SRO 1035(1)/2017 dated October 16, 2017 on refrigerator, air conditioners, washing machine and other similar goods, imported by the petitioner.
Counsel argued that petitioner has no other remedy but to prefer the titled constitutional petition, challenging inter alia, imposition of regularity duty.
Citing Chairman Federal Board of Revenue, Secretary Revenue Division, Collector of Customs Collectorate Appraisement West, Collector of Customs Collectorate Appraisement East and Collector of Customs Collectorate Appraisement Port Muhammad Bin Qasim as respondents, importer pleaded the court to declare the act of the respondents as illegal, mala fide and arbitrary.
He also pleaded the court to set aside impugned valuation ruling and restrain them from taking any coercive action against the petitioner till final order in this petition.
