KARACHI: The Sindh High Court (SHC) issued notices to the tax authorities and deputy attorney general of Pakistan on a constitutional petition filed by Munira W/O Saifuddin, proprietor of M/S International Marketing Services seeking restoration of her sales tax registration number suspended by customs authorities.
While the hearing, a two-member bench comprising Justice Aqeel Ahmed Abbasi and Justice Khadim Hussain M. Shaikh also directed the respondents to file their respective comments on the next date of hearing. The court also adjourned the hearing for December 19, 2016.
Earlier, counsel for the petitioner stated that petitioner is engaged in the business of import & export and regularly paying duty and taxes accordance with law, however, dated 03/06/2016 staff of the customs authorities issued show cause notice to the petitioner and alleged that the petitioner claimed input tax on the invoices issued or the various black listed units.
According to the petitioner, petitioner joined the proceedings and filed reply through letter dated 20/06/2016 but prior to considering the reply of the petitioner, respondents suspended the sales tax registration number of the petitioner effect from 20/06/2016 without giving any plausible reason and unlawfully.
Citing Chairman Federal Board of Revenue (FBR), the Commissioner Inland Revenue Zone-II Regional Tax Office-III and the Assistant Commissioner Inland Revenue Zone-II Regional Tax Office-III as respondents, petitioner pleaded the court may declare that act of the respondents is illegal, mala fide and arbitrary, petitioner also pleaded the Sindh High Court (SHC) may set aside impugned order and restore her sales tax registration number.
