KARACHI: The Sindh High Court (SHC) issued notices to the tax authorities and deputy attorney general of Pakistan on a constitutional petition filed by M/s A-One Sewing Machine Co against the valuation of industrial sewing machine needless at the rate of $44.08 per kg instead of US$ 1.98 per kg.
A two-member bench comprising Justice Irfan Sadat Khan and Justice Muhammad Humayun Khan was hearing the petition.
During the hearing, counsel for the petitioner stated that officials of the tax authorities enhanced the value of the goods imported by the petitioner without any legal and lawful justification.
The court adjourned the hearing for November 17, 2016 and also directed the respondents to file their para-wise comments on the next date of hearing.
Earlier, counsel for the petitioner stated that petitioner imported a consignment of industrial sewing machine needless origin brand Korean origin from United Arab Emirates (UAE) filed goods declarations dated 22/09/2016 which was declared at unit value $1.98 per kg, however, respondents arbitrary and unlawfully enhanced in a whimsical moreover at the unit value of $44.08 per kg.
Citing Sectary Revenue Division, the Collector of Custom Model Custom Collectorate Appraisement West as respondents, petitioner pleaded the court may declare act of the respondents is illegal, unlawful and mala fide.
Importer also pleaded the SHC may set aside the above valuation which was enhanced illegally and restrain the officials of the custom authorities from taking any coercive action against the petitioner.
