KARACHI: The Sindh High Court (SHC) has extended the stay order for three weeks on a constitutional petition filed by M/s Nandos Pakistan (Private) Limited against impugned recovery notice of Rs 33.4 million issued by Deputy Commissioner Inland Revenue.
A two-member bench, comprising Justice Muhammad Iqbal Kalhoro and Justice Khadim Hussain M Sheikh, was hearing the petition.
During the hearing, the counsel for the petitioner prayed for extension of restraining order issued on June 1, 2016, operating in this petition by virtue of which this petition was disposed of in the terms, whereby the appellate authority was directed to dispose of the appeal filed by the petitioner within 45 days and pending such appeal no recovery proceedings were ordered to be initiated against the petitioner.
Counsel argued that although the appeal has been heard by the appellate authority but the same has been reserved for judgment and since the period of 45 days wherein no coercive proceedings were to be initiated against the petitioner has lapsed. Therefore the petitioner apprehension that before his appeal is decided on merits, the department would initiate recovery proceedings against him.
Petitioner’s counsel pleaded the SHC may extended the stay period and restrain the respondents from taking any coercive measures against the petitioner.
After the arguments court disposed of the petition with direction that ” application is disposed of in the terms whereby, further 3 week’s time from today is extended during which no coercive action shall be initiated against the petitioner.
