KARACHI: The Supreme Court of Pakistan (Karachi Registry) dismissed the petition as withdrawn filed by Director Customs Intelligence & Investigation challenging impugned order of the Sindh High Court (SHC) directing de-blocking of Zeeshan Afzal, proprietor of M/s K.K Metal Industries alleged involving in mega mis-declaration scam.
On August 2, 2019, a two-member bench, comprising Justice Mushir Alam and Justice Munib Akhtar heard the matter.
During the hearing, counsel for the customs department argued that on the direction of customs department, he wants to withdraw this case. After the hearing, court dismissed the petition as withdrawn.
Earlier, counsel informed the court in his petition stated that MCC Sialkot has issued show cause notice and blocked user ID/ NTN of Zeeshan Afzal, Proprietor of K.K Metal Industries, Sambrial Sialkot due to his involvement in the offence of series of mis-declaration and gross misuse of transshipment facilities.
He further argued that the Sindh High Court (SHC) passed an order dated June 5, 2018 that “till decision by the appellate tribunal, petitioner will not claim any refund of sales tax, accordingly, petition stands disposed of along with listed application with directions to the respondent to de-block the user ID of the petitioner within two days and submit compliance to this court through MIT within seven days from the date of this order, the request of the petitioner for delay and detention certificate also be considered by the respondent in accordance with law”.
Counsel argued that SHC passed such order without appreciating the facts and ground, evidence and law applicable, which was challenged in this petition, however, appellate tribunal announced verdict and has directed customs officials to blocked importer’s ID/ NTN due to his involvement in mega mis-declaration scam, therefore, customs department does not press this petition further, therefore, court may disposed of this petition.
