Peshawar AFU submits contravention case against M/s Ayaan Enterprises

PESHAWAR: Directorate of Customs Intelligence and Investigation submitted contravention report against Air Freight Unit (AFU) made contravention case against M/s Ayaan Enterprises involved in evasion of huge duty and taxes.

Sources told Customs Today, that Director Customs I&I Dr. Arslan received credible information that M/s Ayaan Enterprises Office No SF-312 Deans Trade Center Islamia Road found involved in evasion of duty taxes during September 2016 to March 2017.

During scrutiny of import documents it was revealed that mobile accessories and other goods were imported from China by evading legitimate duty and taxes.

Sources told that according to airways bill of 37 consignments, freight paid to the carrier was $ 34858 for the imported mobile phones pouches, mobile phone protectors and other goods of 87915 kilograms but duty taxes were not paid after inclusion of freight charges.

The sources told that most of the quantities imported of pouches for mobile phones and their value was declared without enclosure of freight charges as per Valuation Ruling No.908 dated August 2016, it added that as per valuation ruling the value of mobile phones pouches was fixed $0.10 while assessing officer appraised the same value and not included the freight charges paid through MAWB.

The sources notified that in para-8 of said valuation ruling it has been clearly stated that “in case of consignments imported by air, the assessing officer shall take into account the differential between air freight and sea freight while applying the customs value determined in this ruling”. Whereas as per said ruling the assessing officer failed to take into account the differential between air freight and sea freight while assessing the value of pouches therefore the importer succeeded to clear the pouches on lower value and evaded huge amount under heads of duty taxes amounting Rs5.736 million.

Similarly various other imported items like mobile phone protectors, chargers, hand frees, empty packing, artificial jewelery was also cleared in above said 37 GDs on lower value in shape of airways bill without paying duty taxes.
