KARACHI: The Directorate of Post Clearance Audit-PCA has made two audit observations against M/s Colgate-Palmolive (Pakistan) Limited under Section 26 and 32 of the Custom Act-1969 for evasion of duty, taxes amounting Rs45,60,423 and Rs9,41,19,123, respectively.
According to details, the PCA authorities, during the scrutiny of import data of M/s Colgate –Palmolive (Pakistan) Limited, found that the said importer with active connivance of clearing agent M/s Qazi Anwar-Ul-Hasan has imported various consignments of “Colgate brand tooth-brushes under PCT Heading 9603.2100 and also cleared the goods at lower values than the values determined by the Directorate General of Customs Valuation Department.
It has also been observed that the importer was intentionally involved in evading the legitimate duty/taxes with mala fide intention to deprive the government from its legitimate revenue.
During the scrutiny, it was also found that the importer M/s Colgate-Palmolive Pakistan Limited was evaded the duty/taxes in terms of Custom Duty i.e. Rs492699; Regulatory Duty i.e. Rs985,398; Sales Tax i.e. Rs1926454; Additional Sales Tax i.e. Rs339962 and Income Tax i.e. Rs815,910 which amounting total Rs4560423.
Similarly, the PCA authorities during the scrutiny of another consignment of the said importer was found that the importer and its clearing agent were also involved in tax evasion of Rs94119123 in terms of Custom Duty amounting Rs28800221; Regulatory Duty i.e.Rs14,400,111; Sales Tax i.e. Rs31824244; Additional Sales Tax i.e. Rs5616043 and Income Tax i.e. Rs13478504 which amounting total Rs94,119,123.
The authorities concerned of Post Clearance Audit-PCA has directed the importer to pay the above mentioned amount within 10days in order to avoid any further legal action.
