KARACHI: The Sindh High Court (SHC) has issued notices to the Customs Department and deputy attorney general, directing them to file their respective para wise comments on a constitutional petition filed by M/s SN Company seeking restoration of its sales tax return number. A two-member bench, headed by Justice Munib Akhtar, was hearing the petition.
During the hearing, counsel for the petitioner submitted that it is engaged in the lawful manufacturing of paper tube and sale/ supply to various clients which are in textile sector. On March 28, 2018, the commissioner Inland Revenue Zone-V, RTO-III issued him a show cause notice and illegally, unlawfully, claimed/ adjustable input sales tax of Rs 295,435 during the period from July 2013 to June 30, 2017. The counsel argued that respondents also suspended its sales tax return number without fulfilling legal procedure.
Citing Chairman Federal Board of Revenue, Commissioner Inland Revenue Zone-V, RTO-III as respondents, petitioner pleaded the court to declare the act of the respondents as illegal, mala fide and arbitrary, he also pleaded the court to direct them to restore its sales tax return number and restrain them from taking any coercive action against the petitioner.
