KARACHI: M/s Mubeen Industries, SKF Collection and Radium Silk Factory approached the Sindh High Court seeking release of consignments of polyester yarn detained by customs officials due to disputed valuation.
On March 15, 2019, counsel for the petitioners stated in their petition that they have imported consignments comprising of polyester yarn on unit value of $1.30 per kilogram and filed Goods Declaration (GDs) according with law.
Counsel argued that petitioners are seriously aggrieved and highly prejudiced by the actions of the respondents, whereby the respondents have denied to accept the declared value of the imported consignments and are assessing the duty and taxes on the basis of the Valuation Ruling No 1338/2018 dated October 25, 2018 issued by the DG Valuation, despite the fact the impugned valuation ruling is not sustainable in the eyes of the law.
Citing chairman Federal Board of Revenue, collector of Customs Collectorate East, Collector of customs Collectorate West, the Director, Directorate General of Customs Valuation as respondents, he pleaded the court may to declare that act of the respondents as illegal, mala fide and arbitrary.
Importers pleaded the court to direct them to release their consignments and restrain them from taking any coercive action against the petitioner till final order in this petition and grant any other relief deemed just and appropriate in the circumstances of the case.
