KARACHI: M/s Motiwala Jewellers moved the Sindh High Court (SHC), challenging impugned demand notice of Rs16,896,254 issued by Additional Commissioner Inland Revenue Range-A, Zone-III Regional Tax Office-II.
Muhammad Hanif, proprietor of M/s Motiwala Jewellers stated in its constitutional petition that petitioner is an importer and exporter of gold and derives income from running a jewellery shop, he also drives rental income and during the year also received foreign remittances, counsel argued that his client always fulfils all liabilities according to the law.
He further submitted that additional commissioner Inland Revenue Range-A, Zone-III Regional Tax Office-II issued notice for tax demand of Rs16,896,254 being aggrieved he moved and filed appeal before Commissioner Inland Revenue Appeals-IV along with stay application, however, stay has not been granted yet, therefore, he has apprehension of coercive measures from respondents.
Citing Commissioner Inland Revenue Range-A, Zone-III Regional Tax Office-II, Additional Commissioner Inland Revenue Range-A, Zone-III Regional Tax Office-II and Commissioner Inland Revenue Appeals-IV as respondents, he pleaded the court may declare that act of the respondent is illegal, mala fide and arbitrary, he also pleaded the court may restrain the tax department from taking any coercive measures against the petitioner till final disposal of its appeal pending before CIR Appeals.
