KARACHI: The Sind High Court (SHC) restrained customs officials not to take any adverse action against the petitioner on a constitutional petition filed by M/s Hassan Fabrics against imposition of anti-dumping duty on consignments of polyester filament yarn.
On October 10, 2018, during the hearing, a two-member bench, headed by Justice Aqeel Ahmed Abbasi, also issued notice to the customs officials and directed them to file comments on next date of hearing.
Counsel for the petitioner argued that petitioner imported six shipments of polyester filament yarn from China and filed Goods Declaration according with law; however, officials of the customs department imposed anti-dumping duty illegally.
Citing Secretary Finance, chairman Federal Board of Revenue, National Tariff Commission, collector of Customs Appraisement East and other as respondents, importer pleaded the court to declare that act of the respondents as illegal, mala fide and arbitrary.
Importer also pleaded the court to restrain them from taking any coercive action against the petitioner till final order in this petition.
