KARACHI: The Sindh High Court (SHC) directed customs officials and deputy attorney general to file their comprehensive para-wise comments on a petition filed by M/s Chaudhary Steel seeking release order of its imported 54245 kilograms iron & steel remeltable cutting scrap.
On February 18, 2019, a two-member bench headed by Justice Aqeel Ahmed Abbasi was hearing the matter.
During the hearing, counsel for the petitioner stated that petitioner is engaged in the lawful import of iron & steel remeltable cutting scrap and always fulfills all the legal formalities according with law, the petitioner imported above-mentioned goods from UAE and filed Goods Declaration (GDs) according with law.
He further argued that he was shocked when he received a show-cause notice which was issued by customs department alleging that importer willfully and deliberately mis-declared the description, classification and weight and value of said goods.
Citing chairman Federal Board of Revenue, collector of Customs Appraisement East and others as respondents, he pleaded the court to declare that act of the respondent as illegal, malafide and arbitrary.
He further pleaded the court to direct them to release its consignment immediately and restrain them from taking any coercive action against the petitioner till final order in this petition.
