KARACHI: The Sindh High Court (SHC) issued notices to the custom officials and directed them to file their para wise comments on a petition filed by M/s Chain Channel International seeking release of its consignment of roller chain seized by customs officials due to disputed Valuation Ruling No 1268/2018.
A two-member bench, headed by Justice Aqeel Ahmed Abbasi, was hearing the matter on September 10, 2018.
During the hearing, counsel for the petitioner stated that petitioner is engaged in the lawful business of import of the roller chain in the brand of M/s Al-Shaikh Associates and always fulfills all the liabilities according with law and never involved in any crime.
Counsel argued that petitioner is seriously aggrieved by the action of the Collector of Customs Collectorate Appraisement which issued and assessing the imported consignments of the roller chain under Valuation Ruling No 1268/2018 dated 07/03/2018 and enhanced 100% at the same without fulfilling legal requirement.
Citing Chairmen Federal Board of Revenue, Chief Collector of Customs Collectorate Appraisement South, Collector of Customs Collectorate Appraisement East, Director General Valuation as respondents, petitioner pleaded the court to declare that act of the respondents as illegal, mala fide and arbitrary. He also pleaded the court to set aside impugned notification and restrain them from taking any coercive action against the petitioner till final order in this petition.
