LAHORE: The Lahore High Court (LHC) has restricted the Federal Board of Revenue (FBR) from recovering tax from M/s. Bismillah Trading and sought comments from the FBR during three weeks time.
According to details, Justice Mansoor Ali Shah of the LHC conducted the hearing of the case. The counsel for the petitioner, Mohsin Virk advocate, said that the FBR issued notice to his client under direct tax which is totally illegal. He said that according to the law, the FBR must issue a tax notice before sending a recovery notice. He said that according to the law, the petitioner should file an appeal against the tax notice. But the FBR issued direct tax notice to his client which is illegal and should be declared as null and void.
After hearing the arguments Justice Mansoor Ali Shah of Lahore High Court directed Federal Board of Revenue to submit his reply during three weeks time and adjourned the case.
