KARACHI: Four importers approached the Sindh High Court (SHC) seeking relief for not to apply valuation on their consignments of having description ceramic & porcelain tiles under section 25-A vide Valuation Ruling No 874/2016 and contempt proceeding against customs officials.
On August 7, 2018, counsel for the M/s Qureshi Sons, M/s Pak Traders, M/s M.I Sanitary Store and M/s Area Associates stated in constitutional petition that they are doing business of import and trade of goods having description of ceramic & porcelain tiles and customs values of the said goods were determined under section 25-A vide Valuation Ruling No 874/2016 which was being applied on the goods imported and to be imported by the petitioners for assessment of duties and taxes.
Counsel argued that the common judgment dated 19/03/2018 has become operative liable to be implemented by the respondents. The respondents are making contempt of aforesaid common judgment of court and assessing the goods of the petitioners arrived and to be arrived on 12.5% enhanced customs value determine by the respondents by applying Order-in-Revision dated 04/08/2016 which is not in the field being set aside by the Customs Appellate Tribunal as well as this court.
Citing Chairman Federal Board of Revenue, Collector of Customs West, East, Port Muhammad Bin Qasim and others as respondents, they pleaded the court to settle this petition with direction to respondents for implementation of common judgment which making assessment of duty and taxes etc of goods of the petitioners which are subject matter of this petition, in case of contempt on part of any of the respondents, proceedings under article 204 of the constitution of Pakistan 1973 would be initiated.
