ISLAMABAD: The Islamabad High Court reserved a decision on a couple of tax references during the fourth week of February filed by M/s Al Catel Lusent Pakistan Limited and M/s Biafo Industries.
The IHC Bench, comprising of Justice Athar Minallah and Justice Miangul Hassan Aurangzeb, heard the matter filed by M/s Al Catel Lusent Pakistan Limited. It had filed the case against the LTU Islamabad.
Appellate Tribunal Inland Revenue (ATIR), Federal Board of Revenue (FBR), officers of the LTU including Commissioner Inland Revenue, Deputy Commissioner Inland Revenue and Commissioner Inland Revenue (Appeals), were made respondent in the case.
M/s Al Catel Lusent Pakistan Limited had filed the case seeking restrictions to the LTU Islamabad about recovering of outstanding tax amount or making any other coercive move prior to court’s directions on the issue.
Justice Aamer Farooq of the IHC heard the matter filed by M/s Biafo Industries and reserved the decision after hearing arguments from both sides.
M/s Biafo Industries had prayed the court that issued order by the tax authority may kindly be suspended till the decision of appeal pending before the field office of the Board.
Meanwhile, the bench also heard M/s Telenor Pakistan Private Limited and M/s AKA CNG Filling Station cases and adjourned the hearing for coming days.
Justice Aamer Farooq heard the initial arguments on the cases and directed the department’s counsels to provide details of the show-cause notices issued to the appellants at the earliest. With the said directives, the court adjourned the hearing for coming week.
M/s Telenor Pakistan Private Limited and M/s AKA CNG Filling Station had filed the reference in which the companies had challenged the show-cause notices issued by the Large Taxpayers Unit Islamabad.
M/s Telenor Pakistan Private Limited had challenged the act of recovery of said amount by the Commissioner Inland Revenue of Large Taxpayers Unit Islamabad.
