ISLAMABAD: The Islamabad High Court (IHC) has issued notice to the Customs Appellate Tribunal and the Federal Board of Revenue (FBR) in a case filed by M/s Wahaj Enterprises.
A division bench of the IHC comprising Justice Athar Minallah and Justice Mohsin Akhtar Kiyani heard the matter filed against Customs Appellate Tribunal challenging a decision of it pertaining to customs duty (CD).
M/s Wahaj Enterprises had filed the reference in which the company had challenged a decision announced by the tribunal in which it had sustained an order given by department’s adjudication pertaining to customs duty imposed on import of sports goods.
The appellant had challenged the announcement stating that it had no legal grounds and must be set aside in order to bring relief to the appellant.
The appellant had prayed the court to declare the act as illegal and without any lawful authority and an interim stay may be granted against the case. Customs Appellate Tribunal and officers of FBR filed office were made respondent in the case.
