ISLAMABAD: The Islamabad High Court (IHC) on Friday disposed of a tax matter, challenging a show cause notice issued by the field office, the Regional Tax Office Islamabad, of the Federal Board of Revenue (FBR).
Appellant Zafar Mahmood had had challenged a decision announced by the Regional Tax office (RTO). However, the IHC single bench comprising Justice Miangul Hassan Aurangzeb disposed of the case with directions to the board to resume the hearing on the appellants appeal pending before the LTU officer.
The Appellate Tribunal Inland Revenue and officers of the RTO, including Commissioner Inland Revenue, Deputy Commissioner Inland Revenue and Commissioner Inland Revenue (Appeals), were made respondents in the case.
The appellant had asked the court that RTO had not heard his complaint about payable outstanding tax amount stated in RTO show cause notice. He prayed the court to direct RTO not to recover the said amount and abstain from any coercive action in this regard.
The petitioner had prayed the court operation of the impugned order issued by the tax authority may kindly be suspended till the decision of appeal pending before the RTO.
Zafar Mahmood had also mentioned that departmental obligations were not met amid processing the notice of recovery demand while later the adjudication did not addressed grievances of the appellant too.
The appellant had submitted before the court that the impugned order was issued under mala fide intentions and had no legal standing or authority and the court may decide on relief which it deemed appropriate in this regard. It also stated that due legal course was not followed by the department in issuing the order.
