LAHORE: The Federal Tax Ombudsman (FTO) on Tuesday remanded back tax refund appeal filed by proprietor of M/s Techno Commercial against the Regional Tax Office-II (RTO-II) Lahore.
FTO advisor Mian Munawar Ghafoor heard the case filed by proprietor of M/s Techno Commercial in which counsel for the appellant argued that RTO-II had failed to release the refund to the appellant of three years.
He said the RTO had been collecting excessive tax from the company for the last three years. He approached the officers concerned many times for release of refunds but the RTO-II officials did not entertain his requests, even after the passage of a reasonable period.
Finally, the appellant decided to move the FTO seeking his intervention in the case. The counsel appealed the FTO advisor to direct the RTO to clear the refund claims at the earliest.
The counsel further said that delay in release of refund claims put burden on the taxpayers, adding that the RTO should audit the cases and release the extra amount collected by it from the taxpayers.
On the other hand, counsel for RTO maintained that the appellant did not submit all the record to the office on which basis he is claiming refunds. If appellant provides an accurate record, the RTO-II will release the refunds, if any, after a proper assessment, he added.
After hearing the arguments from both sides, FTO advisor remanded back the case until next date for further hearing and directed the parties to appear on said date to present arguments in the case.
