FAISALABAD: Deputy Collector Customs Adjudication Asma Hameed has issued an Order-in-Original (ONO) in favour of the Customs Intelligence and Investigations (I&I) while declaring the seizure of foreign origin grey cloth legal.
According to details, the driver was asked to produce documentary proof of the import of the cloth but he failed to do so. The cloth was being smuggled into the country without paying duty and taxes.
The driver of the vehicle was identified as Muhammad Zafar Munshi, a resident of M/S Pak International Goods Transport Company’s area, opposite to Niab Gate, Jhang Road.
The customs staff forwarded the case to adjudication for further proceedings.
During the hearing, neither anyone appeared to defend the case was nor any written reply submitted despite giving many opportunities. An Inspector of the Customs Department appeared from the prosecution side and asserted that the seized goods falls under the Section 2(s) of the Customs Act-1969 read with current import policy order. It is therefore established that the respondent has nothing to defend against the allegation framed in the show cause notice.
After hearing the arguments, Deputy Collector Asma Hameed decided the case on the basis of facts and material available in the file and issued the ONO and declared the seizure of cloth as legal under Section 156(1)89 of the Customs Act-1969 read with SRO.
