FAISALABAD: The Deputy Collector Customs Adjudication Asma Hameed declared the seizure of non duty paid vehicle as legal.
Sources told Customs Today that following credible information regarding the smuggling of Toyota Fielder bearing registration no: AAN-349 (Quetta). The customs staff intercepted a vehicle near Jhang Bypass Faisalabad. On demand, owner of the vehicle failed to provide documents regarding legal import or lawful possession of the vehicle.
Therefore, the officials confiscated the vehicle under Section 17 of the Custom Act, 1969 read with Section 2(s) and sent case to the adjudication.
During hearing in adjudication, no one appeared to defend the case from respondent side nor any written reply has been received from the respondent despite given ample opportunities of hearing. Muhammad Ramzan inspector appeared from the prosecution side and asserted the seizes vehicle falls under the ambit of section 2(s) of the customs act 1969.
Hence it is established that the respondent have nothing to defend against the allegations framed in the show cause notice. The case is therefore, decided on basis of the facts and material available on the file.
After hearing arguments, the adjudication authority Deputy Collector Asma Hameed stated outright confiscation of the seize vehicle in favour of the federal government under section 156(1)89(i) of the Customs Act 1969.
