KARACHI: Director of Directorate of Post Clearance Audit Customs has moved the Sindh High Court (SHC), challenging impugned judgment of appellate tribunal over exemption of sales tax @ 0% under SRO 509(1)/2007 on consignment of Titanium Dioxide.
According to the details, counsel for the applicant stated in its special customs reference application that M/s ICI (Private) Limited imported 15 consignments of titanium dioxide from Germany and declared/ self-assessment the same under attracting @ 5% customs duty exemption of sales tax @ 0% under SRO 509(1)/2007.
According to the applicant, during the test, report was revealed that goods were chargeable to customs duty @ 5% & special excise duty in terms of SRO 655 (1)/2007 and evaded the duty and taxes in the tune of Rs2,06,04,231. Therefore notice was issued to the above mentioned respondents, however, it moved appellate tribunal and filed an appeal. Counsel further argued that appellate tribunal accepted its appeal without considering facts, illegally.
Citing M/s ICI Private Limited as respondents, applicant pleaded the court to set aside impugned order of the appellate tribunal and restore it. A two-member bench, headed by Justice Munib Akhtar will take up the special customs reference.
