KARACHI: The Customs Court issued notices to the customs officials and special prosecutor of customs department on a bail petition filed by suspect namely Muhammad Shareef son of Abdul Salam, who was booked in a case of attempting to smuggle non-duty paid 156 Samsung brand LED TVs and others contraband goods.
During the hearing on August 03, counsel for the above mentioned accused moved bail petition and argued that his client is innocent and was falsely implicated in this case, who is ready to face trail and will appear every and each date of hearing before the court, therefore, court may grant him bail till final order in this case.
According to the prosecution, M/s Sagheer Enterprises imported a consignment from Jebel Ali and filed Goods Declaration (GDs) for clearance thereof, declaring description of the goods as used auto parts weighing 25000 kilogram at declared/ self-assessed total value of $4,840, on receipt of a credible information, the consignment was selected for joint examination by the staff of PICT examination and R&D section.
Prosecution further revealed that during the search, goods were found inside the container 156 Samsung Brand LED TVs, new genuine auto parts of Japanese, 90 bales of new ladies polyester suiting fabric net weight 4500 kgs approx, new ACs compressors 92 pcs, new batteries etc.
Investigation officer said that during the investigation, it is established that the accused importer Usman, proprietor of M/s Sagheer Enterprises, Lahore, Rahamatullah Quetta and Muhammad Shareef son of Abdul Saleem Khan Kakar, Quetta have deliberately mis-declared description to get illegal clearance of the banned items under the garb of transshipment cargo and also evading legitimate amount of duties and taxes in the tune of Rs8,323,009.
According to the prosecution, they have, thus, contravened provision of Section 15, 32, 32-A, 79, 121, 151-1 and 192 of the Customs Act, 1969 punishable under clauses 9, 14, 14 A, 43, 44, 45, 46, 63, 101 and 86 of Section 156 (1) ibid read with allied laws and procedure.
