KARACHI: Customs Taxation and Anti-Smuggling Court Judge Syed Faiz Rasool Rashdi has issued notice to special public prosecutor of the Customs Department on an after arrest bail application filed by accused person namely Muhammad Yousaf son of Shah Muhammad Khan who is booked in smuggled and pirated Samsung mobile phones and violation of Copyright Act.
During the hearing, counsel for the accused filed an application for after arrest bail, saying that his client was innocent and falsely implicated in this case. The court issued notice to special public prosecutor.
According to the prosecution, Muhammad Naeem son of Muhammad Ibrahim sub attorney of M/s Ckeakers lodged complaint regarding pirated/ replicated copies of Samsung mobile phones being sold out/ distributed/ supplied in local markets as well as the others cities by infringing copy right of actual copyright owner.
On a compliant, a team of Federal Investigative Agency (FIA) conducted raid at Abdullah Haroon Raod, Electronic Market Saddar Karachi and found persons Muhammad Yousaf S/O Shah Muhammad Khan and Ali Ahmed S/O Abdul Ghafoor and recovered huge quantity of replicated/ pirated mobile phones having logo of Samsung, IMEI stickers, boxes of mobile phones etc.
According to the prosecution, they disclosed that they used to bring/ smuggle the pirated mobile phones from Afghanistan by cross the border of Chaman (Baluchistan) and through khapias (carriers), they also voluntarily admitted their involvement in committing infringing the copy right of the actual copyright owners by keeping/ string/ sale/ purchase and distribution/ supplies of the recovered pirated/ replicated phones having logo of Samsung.
Case was registered in violation of under section of 15, 156 (1) (9) Customs Act, 1969 read with section 56, 66, 66-A copyright order 1962 FIA.
