KARACHI: The Customs Court granted bail to suspects namely Saeed Khan son of Ghulam Nabi and Tariq Ahmed son of Bashir Ahmed, who were booked in a case of attempting to smuggle 695 packets of gutka.
On October 05, 2018, counsel for above-mentioned suspects moved bail petition and argued that applicants are innocent and have been falsely implicated in this case. He further argued that the accused persons are the driver/cleaner of the vehicle from which the contraband goods were secured.
He further argued that the applicants were neither owner of the goods nor claimant of the seized goods; therefore, court may grant them bail. However, Special Prosecutor for the State Raja Ghulam Murtaza opposed bail petition.
After the arguments, court granted bail and observed in its order that “accused are admittedly driver/cleaner of the vehicles and not the actual beneficiary/claimant of the seized goods, the offence falls under Clauses (89) of Section 156 (1) of the Customs Act, 1969 which is punishable with six years imprisonment and as such does not fall within the clause of section 497 Cr. P.C. Challan has been submitted and the custody of the accused persons is no more required by the investigation agency”.
