KARACHI: The Customs Court Judge Syed Faiz Rasool Rashdi granted interim bail to accused namely Zaheeruddin who was involved in a case of evasion of duty and taxes worth Rs7,874,532.
It needs to be pertained here that accused (father & son) namely Shaukat Ali Nadeem son of Muhammad Munshi Khan, proprietor of M/s Sunder Trading Company Lahore and Faisal Nadeem son of Shaukat Ali Nadeem is already on physical remand in the same case.
During the hearing, counsel for the accused Zaheeruddin filed an application for pre-arrest bail and argued that applicant/ accused is innocent and was falsely implicated in this case, he is ready to face trail, however, he has apprehensions of arrest therefore, court may grant him bail till final disposal of this case.
After his hearing, court granted his bail and observed in its order that, “Without touching the merits of the case, ad-interim pre-arrest bail is granted to said accused subject to furnish surety in the sum of Rs2,00,000 with P.R bond in the like amount to the satisfaction of this court.
Customs Court directed accused to join investigations if and when required by the investigation officer and appear before the court on next date of hearing. Court also called the police papers and issued notice to special prosecutor for customs department.
According to the prosecution, case was registered by Intelligence Officer Jehzaib Khan of Directorate General Intelligence & Investigation FBR (Customs Enforcement) in violation section 32 (1) & (2) and 32-A, read with section 25, 79 (1) of the Customs Act 1969 further read with section 3, 6, 7A, 33 and 34 of the Sales Tax Act, 1990 and section 148 (1) of the Income Tax Ordinance 2001 punishable under clauses (14) & (14A) of section 156 (1) of the Customs Act 1969.
