KARACHI: Customs Court Judge Syed Faiz Rasool Rashdi has awarded six months imprisonment (period which has already undergone) and fined of Rs 1.5 million to a suspect Ali Shan. The court acquitted another suspect, Faraz Haroon son of Muhammad Haroon. The suspects were booked in a mega tax evasion case.
During the hearing, both sides counsel completed their final arguments and after their arguments, the count announced the judgment and observed in its order that: “The court reached the conclusion that accused Ali Shan son of Syed Ashraf Hussain is sentence for the period which he has already undergone and is imposed a fine of Rs 1.5 million. If the fine amount is not paid, the accused shall suffer simple imprisonment for further one year. The sales tax authorities also at liberty to recover the refund amount from the accused as alleged”.
The court also observed that, “since charge is not proved against accused Faraz Haroon son of Muhammad Haroon, therefore, he is acquitted. Ali Shan is present on bail and his bond stand cancelled. Accused Faraz Haroon is in custody, he shall be released forthwith if he is not required in any order case”.
According to the prosecution, case crime no 02/2015-16 under section 2 (37) of the Sales Tax Act, 1990 punishable under clauses 33 (11) & (13) ibid was registered against the above named accused persons.
