LAHORE: Customs Appellate Tribunal on Thursday has accepted the appeal filed by the Additional Collector Customs, Railway Station Lahore against the M/s Techno Textiles and others.
Saud Imran member techinical heard the arguments and examined the record produced by learned counsel of appellant and respondents as well.
Judgemnet was passed with remakrs that appeal is accepted and impugned order is set aside with order to remanded back appeal to additonal collector to hear a fresh a passed orde within two month of receipt of report from the collectorate and after giving the opportuniy of being heard to both sides.
As per brief histor of case, M/s Techno Textile imported two consignments of synthetic rubber cots and saught clearce under wrong H S Code.
During the examination the customs autharities charge the taxes and duties
After show cause notice, adjudication proceeding were culminated and order in original was passed with remarks that goods release to its lawful owner and also impose panelty of Rs 15000 on the clearing agents.
Being aggrived with the order, order in original was challanged before the Customs Appellate Tribunal on grounds that order in origianal was passed in mechinical fashion without consideration of facts and relevent laws but the respnondent deneid all alligations and prayed before the court for rejection of same appeal.
After details hearing of case, Customs Appellate Tribunal has set aside order in original and the case remanded back to learned additional collector of customs for fresh order within two months.
