LAHORE: Customs Appellate Tribunal on Thursday has upheld the appeal in seized kits/ components for manufacturing of petrol truck. The appeal was filed by M/s New Allied Motors against Collector of Customs (Adjudication) Lahore and others.
Saud Imran, member techinical bench-I heard the arguments from both parties and decided the case with remarks that appellant has failed to produce documents in the same case. Adding more impugned order is upheld and appeal is dismissed.
As per brief histor of case, Assistant Collector of Customs (Bonds), Customs Collectorate Appraisment, Dryport Mughalpura was reported a case that during the stock verification kits/ components for manufacturing of petrol truck was founded and as per record no goods have been ex-bonded.
On demand, licensee failed to produce any proof of in-bonding and ex-bonding goods. The team found no option to seal the bond.
After the iniatial inquarry by the department, the case was filed before the Customs Appellate Tribunal on the grounds that earlier judicial forum and hear the case as per law and tribunal may hear and set aside the earliear order but the respondent rejected the all allegations. After hearing arguments from both sides, Customs Appellate Tribunal has dismissed the same appeal.
