LAHORE: Customs Appellate Tribunal has rejected appeal of seized Mitsubishi Pajero jeep case. The appeal was filed by Shahbaz Rafique versus Collector of Customs Appeals Lahore.
Imran Tariq, member technical bench-II heard the arguments from both sides and decided the case with remarks that all documents produce by the party are rejected appeal is dismissed.
According to the details, the staff of Customs ASO was intercepted a Mitsubishi Pajero jeep, the available person on seat introduced himself as Muhammad Shafique and claimed the owner of said vehicle.
The same vehicle were detained under section 2 (kk) for further investigation, during the complete examination from Punjab Forensic Science Laboratory the record not mach and same were seized under the relevant law.
After show cause notice, adjudication proceeding were culminated and Order-in-Original (ONO) was passed with remarks that appeal is devoid of merit and customs order is upheld.
Being aggrieved from the order, same appeal was filed before Customs Appellate Tribunal on the grounds that there are lot of missing in the order of adjudication authority and need to hear case in details further. Appellant produce documents to prove the legality of seized vehicle and prayed before the court to hear the appeal and set aside order passed by the earlier authority. On the other side, the responded departed all the record produced by the appellant and present the report of physical verification of vehicle and appeal for the rejection of appeal.
After hearing the arguments from both sides Customs Appellate Tribunal decide the appeal with remarks that appeal not accepted.
