LAHORE: Customs Appellate Tribunal on Monday accepted appeal filed by M/s Zainab Limited and set aside the Order-in-Original passed by the adjudication authority.
Muhammad Shabbir Gujjar, member judicial bench-I heard the arguments presented by the counsels of both parties. The judgment was passed with remarks that the appeal filed by the M/s Zainab Limited is accepted and the case is disposed off.
As per brief facts of case, appellant M/s Zainab Limited filed appeal for the license of duty free shop at Allama Iqbal International Airport for one year.
On the expiry of license, appeal was filed for renewal of license but his application was rejected. During one year, appellant imported cigarettes, perfumes and cosmetics which were not allowed to import. Customs officer found that appellant has evaded duties and taxes.
The show case notice was issued to appellant and adjudication proceeding was culminated and Order-in-Original was passed against the appellant to pay duties and taxes with Rs 10 million penalty.
Being aggrieved with order, an appeal was filed before the Customs Appellate Tribunal that order in original was passed against the facts of case and same is liable to set aside. On the other side, representative of department denied allegations and prayed for the rejection of appeal.
After hearing arguments from appellant and respondent sides, Customs Appellate Tribunal has disposed of same appeal with remarks that no illegality is proved by the department, so appeal is accepted.
