ISLAMABAD: A single bench of the Lahore High Court (LHC), Rawalpindi, comprising Justice Ata Mehmood, has directed customs collectorate Islamabad not to recover penalty of Rs 50 million imposed on modal Ayyan Aliby until May 10, 2016.
According to details, counsel for Ayyan Ali Sardar Latif Khan Khosa appealed to the court to grant a stay order from recovering the said amount from Ayyan Ali until May 10. After listening to his arguments, the court directed the tax authorities not to pursue appellant for the payment of fine.
While on the other hand, Customs Investigation and Prosecution Superintendent Sargham Dil challenged the jurisdiction of the Rawalpindi bench of the LHC. In his statement, Sargham Dil said that the customs adjudication Islamabad authorities imposed penalty on Ayyan Ali, so she should approach the customs adjudication in this regard. He further said that Ayyan Ali committed the crime in the jurisdiction of Islamabad so according to law she did not have right to appeal outside Islamabad.
