KARACHI: The Sindh High Court (SHC) has adjourned the hearing of an appeal filed by Collector of Customs Collectorate Hyderabad against the order of Customs Appellate Tribunal and directed the release of Hino truck bearing registration number AE-1636 loaded with plastic scrap to its owner Long Khan son of Dur Khan.
A two-member bench, comprising Justice Munib Akhtar and Justice Umer Sial, was hearing the petition. Earlier, counsel for the applicant submitted that Hino truck bearing registration number AE-1636, loaded with plastic scrap, was intercepted on the allegation of being smuggled/ non-duty paid. However, owner of the truck moved the Customs Appellate Tribunal which directed to release the said vehicle without considering facts.
Counsel further stated that customs department has sufficient evidences and submitted the same to court, therefore, order of the Customs Appellate Tribunal is illegal, mala fide and no legal effects. He said that department can proof charge against suspect.
Citing Long Khan son of Dur Khan and Customs Appellate Tribunal as respondents, applicant pleaded the court may set aside impugned order of the customs appellate tribunal.
