LAHORE: Collector of Customs Appeals Asif Mehmood Jah has allowed release of Suzuki pickup and 1,152 kilogram of foreign origin shirting cloth after the payment of redemption fine for the release of vehicle carrying the cloth.
According to the details, the Collector of Customs Appeals Asif Mehmood, in his order, said that he examined the case record, considered the grounds of the appeal and verbal arguments advanced by the learned counsel for appellant and the departmental representative. During the hearing, it is found that the impugned goods are freely available in the open market. Moreover, there is no nexus between owner of the vehicle and the seized goods.
He was simply carrying the goods against the normal fare. Therefore , under the circumstance , the 20 percent redemption fine imposed on the Suzuki pickup bearing registration LSE-14/ 533, owned by a poor and innocent driver, was not warranted and too harsh.
The collector said in view of the above, the instant appeal is accepted and the pick up is allowed to be released against redemption fine of Rs 10,000.
The appellant in the case were Umair Hssain son of Muhammad Masood Dar, a resident of Jalalpur Jataian while respondents were deputy collector of customs Collectorate Preventive. The appeal was filed before the Collectorate of Appeal on June, 1 2017.
