KARACHI: The Sindh High Court (SHC) has directed the customs authorities to file their respective comments on a constitutional petition filed by Khalid Hussain , seeking release of his Toyota Surf Jeep registration number BF-8451 model 2002.
A two-member bench, comprising Justice Munib Akhtar and Justice Yousaf Ali Saeed, was hearing the petition. During the hearing, counsel for the Customs Department sought time, therefore, the court granted time and adjourned the matter.
Earlier, counsel for the petitioner stated that Huassain is lawful owner of the vehicle, however, the customs officials detained it without showing any lawful reason and illegally even without given notice under section 171 of the Customs Act 1969.
Citing Secretary Ministry of Finance, Director Directorate General of Intelligence and Investigation-FBR as respondents, he pleaded the court to declare that act of the respondent is illegal, mala fide and arbitrary, he also pleaded the court to direct them to release his vehicle immediately.
