KARACHI: Afroze Textile Industries (Private) Limited approached the Sindh High Court (SHC) against show cause notice issued by the tax authorities alleging that the petitioner revised refunds amounting to Rs76, 542, 848. Court adjourned the hearing for December 08, 2016.
A two-member bench comprising Justice Irfan Sadat Khan and Justice Muhammad Humayun Khan was hearing the constitutional petition.
During the hearing, counsel for the sectary revenue division and deputy commissioner inland revenue zone-1 E&C unit-04 RTO-III filed para wise comments which were taken on record, however, counsel for the petitioner sought time for rejoinder, therefore, court granted time and adjourned hearing.
Court also continued interim order till next date of hearing which was passed on last date of hearing in which court had restrained the respondents from taking any coercive action against the petitioner.
Earlier, counsel for the petitioner stated that officials of the tax authorities issued show cause notice dated 02/10/2015 to the petitioner, alleged that the petitioner was revised refunds amounting to Rs. 76, 542, 848 and involved in tax fraud case.
Citing Sectary Revenue Division and Deputy Commissioner Inland Revenue Zone-1 E&C Unit-04 RTO-III as respondents petitioner pleaded the court may declare that act of the respondents is illegal, mala fide and no of legal effect and court also may restrain the respondents from taking any coercive action against the petitioner.
